Terms of Service

These Terms of Service ("Terms") govern your use of the Via messaging application and related services ("Via", "the Service"), provided by Via Messaging d.o.o. By creating an account or using Via, you agree to these Terms.
1. Eligibility
You must meet the minimum age required in your country of residence to use Via. By using the Service, you confirm that you meet this requirement and that the information you provide, including your date of birth, is accurate.
2. Your account
You register using your phone number. You are responsible for activity that takes place through your account and for keeping your device secure. You agree to provide accurate information and to keep it up to date.
3. The Service
Via provides end-to-end encrypted messaging. Messages are encrypted on your device and relayed through our servers, which act as a blind relay and do not retain delivered message content. We may add, change, or discontinue features over time.
4. Acceptable use
You agree not to use Via to create, send, or share content, or to engage in conduct, that:
- is illegal, or promotes or facilitates illegal activity;
- harasses, threatens, bullies, or intimidates another person;
- is hateful, defamatory, or incites violence or discrimination;
- involves child sexual abuse material or the exploitation of minors;
- is sexually exploitative, obscene, or otherwise objectionable;
- infringes the intellectual property or privacy rights of others;
- distributes spam, malware, or fraudulent or deceptive content;
- attempts to disrupt, compromise, or reverse engineer the Service.
There is zero tolerance for objectionable content and abusive behaviour on Via.
5. Reporting and blocking
Via gives every user tools to control their experience and to flag abuse:
- Block — you can block any user at any time, which immediately stops them from contacting you.
- Report — you can report a user or message for abusive or objectionable behaviour directly within the app, or by contacting us at support@viamessaging.eu.
Because Via is end-to-end encrypted, we cannot read message content. When we receive a report, we act on the information available to us and may warn, suspend, or permanently remove accounts that violate these Terms. We aim to review and act on reports of objectionable content within 24 hours.
6. Your content
You retain ownership of the messages and content you send through Via. You are solely responsible for that content and confirm you have the right to send it. As the content is end-to-end encrypted, we do not access, monitor, or control it, except to relay it to its recipient.
7. Suspension and termination
We may suspend or terminate your access to Via if you violate these Terms or use the Service in a way that harms other users or Via. You may stop using Via and delete your account at any time.
8. Disclaimers
Via is provided "as is" and "as available". While we work hard to keep the Service secure and reliable, we do not guarantee that it will be uninterrupted or error-free, to the extent permitted by applicable law.
9. Limitation of liability
To the maximum extent permitted by law, Via Messaging d.o.o. shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Governing law
These Terms are governed by the laws of the Republic of Slovenia and applicable European Union law. Mandatory consumer-protection rights available to you in your country of residence are not affected.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the app. Continued use of Via after changes take effect constitutes acceptance of the updated Terms.
